1. Agreement and eligibility
By purchasing, accessing, or using ToneIQ Close Lab, you agree to these terms and the Privacy Policy. You must be at least 18 years old and able to enter a binding agreement. If you use the service for a business, brokerage, or team, you represent that you are authorized to accept these terms for that organization.
2. Service
ToneIQ Close Lab provides AI-assisted conversation coaching based on authorized transcripts, notes, and private file links. Reports may include evidence-linked communication scores, trust-rise and trust-drop observations, objection and closing analysis, rewrites, follow-up language, and practice priorities. Human review may be used but is not guaranteed for every workflow unless expressly stated in writing.
The Team launch plan uses one designated billing and member account. Multiple user seats, separate agent logins, team workspaces, and aggregate team analytics are not included unless expressly added to the checkout description or a written order.
3. Authorized content and user responsibility
You retain ownership of content you submit. You grant us a limited license to host, process, reproduce, and transmit that content only as reasonably necessary to provide, secure, support, and improve the service as described in the Privacy Policy.
You are responsible for confirming that you have the legal and contractual right to record, transcribe, share, and analyze every submission. You must provide any notice or obtain any consent required by applicable law, your brokerage or employer, and your agreements with call participants. When authorization is uncertain, do not submit the recording; use an appropriately redacted summary only if you are authorized to do so.
4. Acceptable use
You may not use the service to submit secretly recorded or unlawfully obtained content; impersonate another person; violate privacy, employment, brokerage, intellectual-property, or consumer-protection rights; upload malware; probe or bypass security; share account credentials or private report links with unauthorized persons; reverse engineer protected service components; or use automated traffic that materially degrades the service.
5. Memberships, billing, and cancellation
Membership fees and billing frequency are shown at Stripe checkout. Monthly memberships renew automatically until canceled. You authorize Stripe to charge the selected payment method for recurring fees and applicable taxes. You may cancel through the Stripe billing portal; cancellation generally takes effect at the end of the then-current paid period unless checkout or applicable law states otherwise.
Except where required by law or expressly stated at checkout, fees already charged are non-refundable. A cancellation does not erase previously delivered scorecards. We may suspend new submissions when payment is overdue, a subscription is inactive, usage is abusive, or the account presents a security or compliance risk.
6. Reasonable-use limits
Plans are intended for ordinary professional coaching use, not bulk ingestion, resale, model training, surveillance, or high-volume contact-center processing. We may apply technical or operational limits, pause unusually heavy usage, or propose a different plan when usage materially exceeds the launch service’s capacity. We will not use reasonable-use limits to reduce access arbitrarily after accepting payment for ordinary use.
7. AI and coaching limitations
AI-assisted output may be incomplete, incorrect, or sensitive to the quality of the submitted transcript or notes. Scores are coaching indicators, not validated psychological, legal, compliance, employment, or performance measurements. You are responsible for reviewing suggestions before using them with a client, employee, contractor, or prospect.
The service does not guarantee appointments, listings, accepted offers, closings, commissions, revenue, client satisfaction, regulatory compliance, or any other outcome. Nothing in a report is legal, financial, tax, employment, human-resources, fair-housing, or real-estate brokerage advice.
8. Intellectual property
Globerian Financial Group LLC and its licensors own the service, software, report design, scoring framework, prompts, templates, documentation, page copy, and brand assets, excluding customer content. ToneIQ™, ToneIQ Close Lab™, ToneIQ Trust Index™, Close Lab Scorecard™, Trust Rise™, and Trust Drop™ are trademarks, service marks, or proprietary assets. These terms do not grant rights to reproduce or resell the service or its protected materials.
9. Availability and changes
We aim to operate the service reliably but do not promise uninterrupted or error-free availability. We may change features, models, vendors, limits, or workflows to improve security, quality, or sustainability. Material changes that adversely affect an active paid plan will be communicated through the service, email, or updated checkout terms where reasonably practical.
10. Suspension and termination
You may stop using the service and cancel billing at any time. We may suspend or terminate access for nonpayment, unlawful or unauthorized content, security threats, abuse, material breach, or legal necessity. Sections that by their nature should survive—such as ownership, payment obligations, disclaimers, and limitations—continue after termination.
11. Disclaimers and responsibility
The service is provided on an “as available” basis to the extent permitted by law. You remain responsible for business decisions, professional communications, recording compliance, fair-housing and anti-discrimination compliance, brokerage supervision, and how you use any suggested language.
12. Changes and contact
We may update these terms as the service evolves. The effective date will be revised when changes are posted. Continued use after an update constitutes acceptance where permitted by law. Questions may be sent to hello@toneiqcloselab.com.
